Paul Allen’s company Interval Licensing LLC, one of the founders of Microsoft has filed again a lawsuit against YouTube, Yahoo, Google Inc and 8 other companies, claiming they infringed on patented Web technology.
Allen’s Interval Licensing, based in Seattle, owns the rights to information systems, computer science and communications technology developed in Silicon Valley by Interval Research, which Allen co-founded in the 1990s, Interval Research no longer exists.
The new filing is an amendment of the lawsuit Interval Licensing filed in earlier this August against Yahoo, YouTube, Google, AOL, Apple, Netflix, eBay, Office Depot, OfficeMax, and Staples.
According to the reports US District Court Judge Marsha Pechman dismissed the original case because it did not name the infringing products.
The new Interval’s lawsuit, is chock full of examples of the 4 patents in question, 2 of the patents are related to the way websites suggest additional, related content to what’s being shown on the screen. It is also reported that Google and Yahoo’s news sites infringe on these patents by displaying related headlines. Search advertising systems and e-mail spam filters of the companies also infringe on these patents. Allen’s company Interval said, as do features on Netflix and eBay that recommend related products or products based on a user’s shopping or movie-watching history.
2 other patents are related to the way computer programs and websites send alerts to the user without disturbing their main activity on the computer, modestly and off to the side. Interval said that the infringing products include Google’s Gmail notification software, Yahoo’s news widget and AOL’s instant messaging system among many other items.
Interval is asking in lawsuit from their defendants for damages and, going forward, either royalties or a ban on the companies’ use of the technology. Observers and experts that this case is a long shot but the potential payoff is large may be $500million, if he wins.
